Terms of Service

These terms of service (the “Terms”) are a binding agreement between person, persons, or entities (“you” or “your”) using Beevault Asset Management’s (“Beevault”) websites (the “Sites”) or Beevault’s Beevault Wallet, the Terms govern your access and use of the Sites or Beevault Wallet. When you use the Sites or Beevault Wallet you are accepting these Terms, and acknowledge that you have read, understood, and agreed to be bound these Terms.

Beevault reserves the right, in its sole discretion, without any obligation and without any notice to you, to change, improve or correct the information, materials and descriptions on the Sites or Beevault Wallet, and to suspend and/or deny access to the Sites for scheduled or unscheduled maintenance, upgrades, improvements, or corrections. The information and materials on the Sites may contain typographical errors or inaccuracies. Any dated information is published as of its date only, and Beevault does not undertake any obligation or responsibility to update or amend any such information. Beevault may discontinue or change any product or service described in or offered on the Sites at any time.

Entire Agreement

These Terms constitutes the entire agreement between Beevault and you with respect to the Sites and the Beevault Wallet and it supersedes all prior or contemporaneous communications, agreements and understandings between Beevault and you with respect to the subject matter hereof.


Use Limitations

All right, title, and interest in the Sites and Beevault Wallet and the content of the Sites is either the exclusive property of Beevault or presented on the Sites or Beevault Wallet subject to a license granting Beevault the right to use or display the content. The Sites are intended for personal, non-commercial use. You may print, copy, and download any information or portion of the Sites for your personal use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, frame, create derivative works from, transfer, or otherwise use in any other way for commercial or public purposes in whole or in part any information, software, products, or services obtained from the Sites, except for the purposes expressly provided herein, without Beevault’s prior written approval. Unauthorized use of the Sites and or any Beevault systems, including, but not limited to, unauthorized entry into Beevault systems, misuse of passwords or misuse of any other information, is strictly prohibited. You may not use the Sites in any manner that could damage, disable, overburden, or impair any Beevault Sites or service or interfere with any other party's use and enjoyment of any Beevault Sites or service. You may not attempt to gain unauthorized access to any Beevault Sites or service, computer systems or networks connected to any Beevault Sites or service, through hacking, password mining, or any other means. You agree that you will not engage in any activities related to the Sites that are contrary to applicable laws or regulations.

You are prohibited from transmitting any unlawful, threatening, libelous, defamatory, obscene, inflammatory, pornographic, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or would otherwise violate the law. Beevault will fully cooperate with any law enforcement authorities or court order requesting or directing Beevault to disclose the identity of anyone posting any such information or materials.

Beevault Wallet Transactions

Transactions performed using Beevault Wallet are irreversible, and by using Beevault Wallet you acknowledge and agree that Beevault, its affiliates, joint ventures, partners, employees, officers, or directors cannot reserve or rescind a transaction initiated using Beevault Wallet. You further acknowledge and agree that Beevault, its affiliates, joints ventures, partners, employees, officers, or directors cannot retrieve your private cryptographic keys or passwords if you lose or forget them. Finally, by using Beevault Wallet, you acknowledge and agree that Beevault Wallet cannot, does not, and has no ability to control the various distributed ledger services, platforms, or technologies available to Beevault Wallet users for transactions, and—accordingly—that Beevault Wallet cannot guarantee or certify transaction confirmations.

Intellectual Property

Beevault retains all right, title, and interest in the content of the Sites and Beevault Wallet, all of Beevault’s brands, logos, trademarks, trade names, and service marks (collectively the “Marks”). You are prohibited from using any Marks for any purpose without the written permission of Beevault or such third party which may own the Marks.

All information and content including its design, images, information, data pictures, text or software programs, HTML, XML, and source and object code available on or through the Beevault Sites ("Content") is owned by Beevault and protected by all applicable copyright laws. You are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works, or using any Content available on or through the Beevault Sites for commercial or public purposes unless specifically allowed herein.

Claims of Infringement

Beevault respects the intellectual property of others and requires that you do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), the text of which may be found on the United States Copyright Office website located at http://www.copyright.gov/legislation/dmca.pdf, Beevault will respond expeditiously to notices of alleged copyright infringement that are duly reported to its Designated Copyright Agent identified in the notice below. If you believe your content has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide Beevault’s Copyright Agent the following information:

  • -Identify the copyrighted work that you claim has been infringed, or—if multiple works are covered by this Notice—you may provide a representative list of the copyrighted works that you claim have been infringed.
  • -Identify the material or link you claim is infringing and provide a description of where the infringing work is located on the Sites.
  • -Provide your mailing address, telephone number and, if available, email address.
  • -Include both of the following statements in the body of the Notice:
    • • I hereby state that I have a good-faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., fair use).
    • • I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed.
  • -Provide your full legal name and your electronic or physical signature.

    Deliver this Notice, with all items completed, to Beevault at:

    While Beevault considers all such notices seriously, you may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that content or activity is infringing. If you are uncertain whether material infringes your copyrights (including whether use of copyrighted material may constitute fair use) you may wish to seek the advice of an attorney.

    Links To Other Sites

    The Sites may contain links to third party websites. Such links are provided only as a convenience. The inclusion of any link is not and does not imply an affiliation, sponsorship, endorsement, approval, investigation, verification, or monitoring by Beevault of any information contained in any third party website. In no event shall Beevault be responsible for the information contained on that website or your use of or inability to use such website. Access to any other internet website linked to the Beevault Sites is at your own risk. You should be aware that linked websites may contain rules and regulations, privacy provisions, confidentiality provisions, transmission of personal data provisions, and other provisions that differ from those provided on Beevault’s Sites. Beevault is not responsible for such provisions, and expressly disclaims any and all liability related to such provisions.

    Information Security and Privacy

    Beevault takes the security of its Sites and Beevault Wallet very seriously, and has implemented appropriate physical, technical and administrative controls to safeguard your information. Despite our efforts, no information transmitted over the internet is completely secure, and by using the Sites or Beevault Wallet you acknowledge that Beevault cannot guarantee that your Personal Information or other data will not be compromised, stolen, or lost.

    By using our Sites or Beevault Wallet you acknowledge that you have taken adequate steps to protect, backup or otherwise secure information you share with Beevault either via the Sites or the Beevault Wallet. Such steps include, but are not limited to: • Using an appropriate password or passphrase; • Not sharing your password or passphrase with any other party; and • Maintaining a back-up of information stored in or on Beevault Wallet.

    BY USING OUR SITES OR Beevault WALLET, YOU FURTHER ACKNOWLEDGE AND AGREE THAT SHOULD YOU LOSE YOUR PASSWORD OR ENCRYPTED KEYS STORED IN Beevault WALLET, Beevault HAS NO MEANS OF RECOVERING, RESTORING, OR ACCESSING THAT INFORMATION WHICH WOULD RENDER CRYPTOCURRENCY STORED IN A Beevault WALLET INACCESSIBLE. Beevault also respects your privacy. Beevault’s privacy policy may be found at here. Beevault’s privacy policy is incorporated into these Terms and is made a part hereof.

    No Warranties

    The Sites and Beevault Wallet have been prepared for the purpose of (i) providing information about Beevault, and its products and services, and (ii) providing custodial wallet services for cryptocurrencies via the Beevault Wallet. Nothing on the Sites constitutes or is meant to constitute advice of any kind. You understand and agree that digital currencies are experimental, non-regulated, bearer instruments that are difficult to secure. You agree that there are risks associated with using a custodial wallet service including, but not limited to, the risk of software or hardware failures, network failures, malicious software, and unauthorized access to your Wallet by malicious intruders or hackers. You agree that we will not be responsible for any communication failures, disruptions, errors, loss of data, or delays you may experience when using the Services, however caused. Though we take what we consider appropriate steps to secure your accounts, we do not warrant or guarantee that your digital currencies will be available to you for withdrawal or for transactions.

    You further agree that there are risks associated with using any digital currency network, including, but not limited to, the risk of unknown vulnerabilities in or unanticipated changes to the digital currency network and its processes. You agree that we have no control over any digital currency network and will not be responsible for any harm occurring as a result of such risks.

    Beevault does not warrant the quality, accuracy, or completeness of any claims, statements, or information on the Sites. Further, Beevault makes no representations about the suitability of any of the information contained on the Sites or any other website for any purpose. All information is provided "as is" and “as available” without warranty or condition of any kind. In no event shall Beevault be liable for any damages whatsoever, including special, indirect, or consequential damages, arising out of or in connection with the use of content available on the Sites. Use of the Sites and any content displayed or made available herein shall be at your own risk.

    Beevault does not warrant the information or services governed by these Terms, either expressly or impliedly, for any particular purpose and expressly disclaim any implied warranties, including but not limited to, warranties of title, non-infringement, merchantability, or fitness for a particular purpose. Beevault will not be responsible for any loss or damage that could result from interception by third parties of any information or services made available to you via the Sites, or via Beevault Wallet. Neither Beevault, nor any of its affiliates, subsidiaries, directors, officers, or employees, will be liable or have any responsibility of any kind for any loss or damage that you incur in the event of any failure or interruption of the Sites or Beevault Wallet, or resulting from the act or omission of any other party involved in making the Sites or Beevault Wallet, the data contained therein, or the products or services offered on the Sites available to you, or from any other cause relating to your access to, inability to access, or use of the Sites or these materials, whether or not the circumstances giving rise to such cause may have been within the control of Beevault or of any vendor providing software or services. In no event will Beevault or any such parties be liable to you, whether in contract or tort, for any direct, special, indirect, consequential, or incidental damages or any other damages of any kind even if Beevault or any other such party has been advised of the possibility thereof. This limitation on liability includes, but is not limited to, the transmission of any viruses which may infect your equipment, failure of mechanical or electronic equipment or communication lines, telephone or other interconnect problems (e.g., you cannot access your internet service provider), unauthorized access, theft, operator errors, strikes or other labor problems or any force majeure. Beevault cannot and does not guarantee continuous, uninterrupted, or secure access to the Sites or Beevault Wallet.

    Force Majeure

    You agree that we will not be liable for delays, performance failures or service interruptions which result directly or indirectly from any cause or condition beyond our reasonable control, including but not limited to, any delay or failure due to any act of God, act of civil or military authorities, act of terrorists, civil disturbance, war, strike or other labor dispute, fire, interruption in telecommunications or internet services or network provider services, failure of equipment and/or software, other catastrophe, or any other occurrence which is beyond our reasonable control.


    These Terms shall be governed in all respects by and construed in accordance with the laws of the State of Delaware, without regard to conflicts of laws principles, except to the extent federal law applies.

    Claims arising out of, or relating to, or connected with these Terms must be asserted individually in binding arbitration conducted by a single arbitrator in accordance with the American Arbitration Association (AAA) rules governing consumer related disputes. The arbitrator selected must have experience with online payment platforms and cryptocurrency. The arbitration shall be conducted in Seattle, Washington, USA. To the fullest extent allowed by state, federal or other applicable law, the arbitrator shall have exclusive authority to resolve disputes about the validity, enforceability, interpretation, applicability or formation of these Terms. In any arbitration arising out of or related to these Terms, the arbitrator is not empowered to award punitive, special, or other damages in excess of compensatory damages, except where such damages are required by applicable law. Further, both you and Beevault expressly waive the right to the recovery non-compensatory damages. Any cause of action you may have with respect to your use of the Sites or Beevault Wallet must be commenced within one (1) year after the claim or cause of action arises.


    If you are a resident of the People’s Republic of China, you consent that any dispute arising from or in connection with these Terms and Conditions shall be submitted to the China International Economic and Trade Arbitration Commission (CIETAC) for arbitration, which shall be conducted in Beijing, China in accordance with the CIETAC’s arbitration, which shall be conducted in accordance of the CIETAC’s arbitration rules in effect at the time the dispute is submitted to arbitration before the CIETAC.

    There is one exception to the arbitration requirements set forth in these Terms: if Beevault reasonably believes you have violated its intellectual property rights, Beevault may seek injunctive or other appropriate relief in any court of competent jurisdiction.
